The majority in Victoria found that Mr Povey's allegations in substance do no more than state a failure to do something that cannot be characterised as an event or happening, and stressed the need to avoid importing notions of common law fault and negligence which are irrelevant for the purposes of determining whether there has been an Art 17 accident. Mr Povey argued that an omission can be an accident, relying on the decision in.
